These General Terms and Conditions (GTC) govern the use of the platform as well as all legal aspects related to the services offered.

Use of the MatchdayDesign.com website constitutes full acceptance of these GTC and the Privacy Policy in their current versions. If you do not agree with these conditions, you must not place any orders or use any services from MatchdayDesign.

MatchdayDesign reserves the right to update or modify these GTC at any time without prior notice. It is recommended to review the GTC regularly.

Disclaimer: We create your designs, picture frames, and phone cases using the images you provide. Please send us only images that you are authorized to use. We assume no liability for any complaints related to the content you provide, which is used for the design and production of your customized products. By sending the images, you confirm that you have permission to use them and that no third-party rights are infringed. If third parties make any claims due to the content provided, you agree to bear all resulting costs, damages, and legal consequences in full, so that MatchdayDesign is not held liable.

1) Information on Products and Prices

1.1 Matchdaydesign.com provides detailed information about the products and services on the website, including descriptions, images, prices, and any additional costs (e.g., shipping costs).

1.2 Prices include statutory value-added tax. Any customs duties, taxes, or additional charges for international deliveries are borne by the customer.

1.3 Matchdaydesign.com reserves the right to change prices or products at any time. Such changes do not apply to orders that have already been completed.

2) Conclusion of the Contract

2.1 Formation of the Contract

The products and services presented on our website do not constitute binding offers but merely an overview of available products. A contract is formed when the customer completes the ordering process in full, the payment is successfully made, and MatchdayDesign confirms the order via email. The contract thus becomes binding only upon MatchdayDesign’s confirmation following receipt of payment.

2.2 Reservation of Acceptance of Orders

MatchdayDesign reserves the right to reject orders or cancel orders that have already been accepted if:

• technical errors occur on the website or during the ordering process,

• there is reasonable suspicion of misuse of the ordering system,

• the customer’s payment has not been successfully completed.

2.3 Defects in Personalized Products

In the event of defects in personalized products such as picture frames and phone cases that arise from production errors or transport damage, MatchdayDesign.com offers a free replacement delivery. If a product needs to be replaced due to such a defect, MatchdayDesign.com ensures that an equivalent replacement product is shipped as quickly as possible.

However, if the quality of the product is impaired by the image uploaded by the customer (e.g., due to low resolution or blurry images), MatchdayDesign.com assumes no responsibility. In such cases, no replacement will be provided, and the customer will be informed that the image quality is insufficient for the final product.

2.4 Cancellation of the Order

Once the ordering process is completed and payment has been successfully received, the order is deemed finalized and can no longer be canceled. From that point onward, work on personalizing or producing the product begins.

2.5 Input Errors and Design Corrections

If an error occurs during the file upload for the design, the customer has 1 hour after placing the order to inform MatchdayDesign.com. If the error is not reported within this time period, the designer will proceed with the uploaded design.

For Basic products, no revision of the design is included in the price. The customer is entitled to one design revision only for Custom Designs, phone cases, and picture frames. For these products, the customer may request a revision of the design before final production and shipping take place.

2.6 Design Approval and Shipping

Our designs are sent to the customer for approval by email within 24 to 72 hours after the order is placed. The ordered products, such as phone cases and picture frames, will only be shipped after the customer has provided written approval of the final design. The customer is therefore requested to respond promptly via email to the design approval to avoid delays.

2.7 Delays in Design Approval

If, for unforeseen reasons—including a very high order volume—it is not possible to meet the 24 to 72-hour timeframe for providing the design, Matchdaydesign.com will inform the customer immediately and ask for understanding. In such cases, the customer will be notified of the new expected date for design approval. If the design cannot be provided within 72 hours, Matchdaydesign.com guarantees that the design will be submitted at the latest within 7 days. Matchdaydesign.com is not liable for delays caused by unforeseeable events such as technical issues, force majeure, or a high volume of orders.

3) Special Conditions for Processing Goods According to Customer Specifications

3.1 The customer is solely responsible for the quality of the uploaded content (e.g., image sharpness, image resolution). Matchdaydesign.com does not check the content. When Matchdaydesign.com designs or personalizes products based on the customer’s instructions, the customer is responsible for providing all necessary content (such as text, images, or graphics). Matchdaydesign is not liable for any reduction in quality or defects of the final product that result from inadequate quality, incorrect formats, or faulty content provided by the customer.

3.2 The customer represents and warrants that they hold the necessary rights to all content provided and that no third-party rights—including copyrights, trademark rights, and rights of personality—are infringed.

3.3 The customer shall indemnify MatchdayDesign against all third-party claims arising from the contractual use of the content provided. This indemnification also includes legal defense costs at the statutory rate.

3.4 MatchdayDesign reserves the right to reject or cancel orders if the content provided:

• violates legal provisions,

• contains unconstitutional, discriminatory, or violence-glorifying material,

• or is otherwise inappropriate.

4) Liability for Uploaded Content

4.1 Customers may only upload content for which they have unrestricted rights of use.

4.2 MatchdayDesign does not review content for its legal admissibility. By uploading, the customer confirms that no copyrights, trademarks, or personal rights of third parties are infringed.

4.3 MatchdayDesign assumes no liability for any claims by third parties arising from the use of uploaded content. The customer is liable for all consequences resulting from any violation of these rights.

5) Prices and Payment Terms

5.1 The prices stated in our online shop are total prices and include statutory value-added tax. Additional delivery and shipping costs are listed in the respective product description or may apply if a minimum order value is not reached. This information is clearly stated during the ordering process.

5.2 Additional costs such as customs duties, taxes, or fees for money transfers (e.g., bank transfer or exchange rate fees) may apply and are borne by the customer. Such costs are incurred regardless of whether delivery is domestic or international.

5.3 The available payment methods are displayed to the customer during the ordering process. Payment must be completed in full before order processing begins.

5.5 MatchdayDesign reserves the right to change the prices of products and services without notice. We are not liable for price changes or discontinuation of products and services.

5.6 Payment delays or unsuccessful payments may result in the cancellation of the order.

6) Delivery and Shipping Conditions

6.1 If MatchdayDesign offers shipping of the goods, delivery will be made within the delivery area stated by MatchdayDesign to the delivery address specified by the customer, unless otherwise agreed. The delivery address provided in the order process is decisive for the transaction. The delivery area is limited to Switzerland and EU countries.

6.2 If delivery of the goods fails for reasons attributable to the customer (e.g., incorrect address entry), the customer bears the reasonable costs incurred as a result. This also applies if a re-delivery becomes necessary.

6.3 MatchdayDesign reserves the right to cancel orders or withdraw from the contract if it is not possible to procure supplies from its own suppliers for reasons beyond MatchdayDesign’s control. In such cases, the customer will be informed immediately, and any payments already made will be refunded promptly.

6.4 It is not possible to collect the goods in person for logistical reasons.

6.5 Gift vouchers are provided to the customer as follows:

• via download,

• via email.

6.6 Personalized products such as phone cases and picture frames are manufactured according to the customer’s specifications. Because these products are unique, there is no right of withdrawal.

6.7 Uninsured shipping is available to the customer as a standard, fee-based option. Insured shipping with tracking is available at an additional cost. Once the goods have been handed over to the shipping service provider, the risk of loss or damage passes to the customer.

6.8 MatchdayDesign assumes no liability for delays caused by shipping service providers or for delivery problems resulting from incorrect information provided by the customer.

6.9 Delays in delivery, regardless of the reason, do not entitle the customer to withdraw from the contract or to reduce the purchase price.

7) Right of Withdrawal

7.1 All products offered on MatchdayDesign.com are fully personalized and are produced according to the customer’s individual specifications.

7.2 Under applicable legal provisions, the right of withdrawal is excluded for personalized products, as they are specifically tailored to the customer’s wishes and cannot be reused.

7.3 By placing an order on MatchdayDesign.com, the customer confirms that they explicitly waive the right of withdrawal, as the ordered products are individually designed.

8) Product Availability

All products and/or services offered on MatchdayDesign.com are generally available unless there are stock shortages or the products are made to order, in which case availability may vary. Products may sell out without prior notice and will be marked accordingly on MatchdayDesign.com.

Should a product become unavailable after the order is completed, MatchdayDesign.com will endeavor to contact the customer as soon as possible via email or telephone to find a quick solution and expedite the process.

9) Limitation of Liability

9.1 MatchdayDesign is not liable for damages arising from the use of the website or the products unless such damages are caused by intentional or grossly negligent acts.

9.2 MatchdayDesign is not responsible for:

• indirect damages,

• damages caused by technical errors or delivery delays.

10) Redemption of Gift Vouchers

10.1 Gift vouchers purchased in the MatchdayDesign online shop can only be redeemed on the website www.matchdaydesign.com.

10.2 Gift vouchers are valid for 3 years from the date of purchase. After this period, they can no longer be redeemed.

10.3 Gift vouchers must be used in full in a single order transaction. Partial redemption or transferring any remaining balance to a future order is not possible.

10.4 Gift vouchers can only be redeemed before completing the ordering process. Subsequent crediting or application to orders already completed is not possible.

10.5 Gift vouchers may only be used to purchase phone cases and picture frames and cannot be used to purchase additional gift vouchers.

10.6 If the order value exceeds the gift voucher amount, the difference must be paid by one of the payment methods offered in the online shop.

10.7 The balance of a gift voucher will not be paid out in cash or earn interest.

10.8 Gift vouchers are transferable and can only be used to purchase phone cases and picture frames on www.matchdaydesign.com. Each voucher code can be used only once. Once the code has been redeemed, it becomes invalid.

10.9 MatchdayDesign assumes no liability if a voucher code is used by an unauthorized third party, for example, through disclosure of the code or unauthorized access. The customer is responsible for keeping the voucher code secure.

10.10 If MatchdayDesign discontinues its business operations or permanently closes the website, any unused gift vouchers lose their validity. In such cases, neither a refund nor any other form of compensation for the voucher value is possible.
